The nearest official support is FCC Public Notice DA 21-363, under which parties may go on relying on their compliance with the pre-2021 rules for equipment already certified and not modified in a way that could affect RF exposure, no review period being needed for such equipment; sections 1.1307 and 2.1093 create no exemption category keyed to when a device was sold. The other three choices correspond to no exemption in the rules at all, being framed as a transmitter output wattage, as radiating only in the near field, and as a dish diameter.

Pool question E0A09. 47 CFR 1.1307(b)(3) sets out the only exemption routes from a routine RF exposure evaluation: available maximum time-averaged power of no more than 1 mW; the threshold power P_th formula, usable from 0.3 to 6 GHz at separation distances of 0.5 to 40 cm; and the ERP-against-distance thresholds in Table 1 to 1.1307(b)(3)(i)(C). None of them is keyed to a date, and 47 CFR 2.1093 evaluates portable devices such as hand-held transceivers against the SAR limits once they exceed those thresholds. FCC Public Notice DA 21-363 of 2 April 2021 set 3 May 2021 as the effective date of the framework and stated that, for equipment, parties may continue to rely upon their compliance with the rules as they existed prior to the RF Report and Order as long as certified equipment is not modified in a way that could affect RF exposure.
